Pools and Spas

In a recent seawall inspection with the City Engineer, we mentioned the existence of a permitted in-ground pool in the neighborhood. We asked if the permitting of in-ground pools or spas contained any enhance engineering requirements to mitigate any infringement on the integrity of seawalls.

His response:
Building & Engineering verifies that pools adjoining waterways in the Channel Islands Harbor area are not imposing additional loading on, or otherwise affecting the integrity of the seawalls. We also verify that the presence of the constructed pool will not infringe on any maintenance easements owned by the City. There are different designs for the seawalls among the different housing tracts in this area that affect the ability of a pool to be permitted.

In the older tracts (Mandalay), pools may not be possible due to the location of seawall maintenance easements, while in Seabridge or Westport there are locations where a pool could be allowed.

Accessory Dwelling Units (ADU)

We requested confirmation on the City’s position on ADUs as there appears to be some disparity between State and Coastal Commission positions.

Within the City of Oxnard, Accessory Dwelling Units are not currently allowed in the Coastal Zone.
In addition, we met with Coastal Commission staff in August 2020, and we discussed the recent changes in state law which generally allows ADUs in residential zones except within the Coastal Zone. The CCC staff encouraged us, and other coastal cities, to allow ADUs within the Coastal Zone. CCC staff suggested that we look at Santa Cruz’s ADU Coastal regulations which provide ADU restrictions / reasons for denial based on lack of parking. As part of the Housing Element, City staff did not propose and City Council did not provide direction to amend our LCP to allow ADUs in the Coastal Zone. You may have noticed a lot of activity recently between Harbor Blvd and “Little Harbor”.

Trees have been trimmed, dead plant material has been removed and more work is coming!

We want to extend thanks to the City and Jeri Cooper and our new Landscape Inspector Lalo Navarro as well as the Contractor Brightview Landscaping Inc., City Corp and our HOA members for working to bring all this about!

Staffing news – Lalo Navarro named new Landscape Inspector for our area (Waterways Zone 1) in October, 2019. Since joining, Lalo has initiated monthly walkthroughs with the landscaping maintenance contractor (Brightview Landscaping, Inc). Mandalay HOA members are working with the City, Lalo and staff to facilitate communication and needed actions/follow-up; Meetings are set for 3rd Tuesday of each month.

Projects progress – Greenbelt rehabilitation, where needed, was initiated (Kingsbridge Lane). Work in progress on buffer area (Harbor Blvd, Channel Island Service roads) to remove dead plants, weeds in preparation to install new trees, irrigation will be checked, and drought tolerant material will be put in place. Mandalay Bay will receive 75 trees through a grant awarded to City.

Mandalay Bay medians’ irrigation systems will be reviewed to assure watering properly.
Review of problematic vegetation on sea walls is anticipated within the next 3 months.

SUBJECT: On-Going Maintenance in Mandalay Bay

Mandalay Bay Residents,

I am writing today regarding the on-going maintenance and projects scheduled for Waterways Zone 1 – Mandalay Bay. Beginning this past October, Mandalay Bay has been assigned a new Landscape Inspector, Lalo Navarro, who will be on property each month for inspections and projects. Lalo has been assigned to the waterways neighborhoods of Mandalay Bay, Harbour Island, Seabridge and Westport. Additionally, Lalo is the inspector who facilitates projects throughout the Special Districts Division.

Landscape Maintenance Contract

In October, the Special Districts Division initiated monthly walkthroughs with the contractor, Brightview Landscaping, Inc. to identify deficiencies in the landscape maintenance throughout the property. Members of the HOA have been in attendance at each meeting and they are working with the City to provide constructive feedback on the maintenance of the District. Staff will meet with HOA representatives and the contractor’s representatives on the 3rd Tuesday of each month barring any rain or holidays to go over maintenance tasks.

Projects

This past summer, Special Districts Inspector, Lalo Navarro, worked with City Corp staff to complete the rehabilitation and replanting of a greenbelt located on Kingsbridge Lane. This project removed overgrown, existing trees and vegetation and replaced it with new, more drought tolerant and less evasive plant materials. The plants are slowly growing and will develop into a nice planting over the next year.

Currently, Special District’s staff is working on a complete rehabilitation of the buffer area of Harbor Blvd and
Channel Islands Service Roads. Staff is working with Work Release and City Corps teams to remove any dead plant material and weeds so new trees can be installed. Once the area is cleaned out, staff will work with the our irrigation contractor to do a thorough irrigation check of the area, install drip lines to feed the new trees and make any repairs to the deteriorated existing irrigation to continue watering of the established plant material.

Mandalay will be the recipient of 75 new trees at no charge through a grant that was awarded to the City. This grant includes an allocation for the cost of watering for these trees. Additionally, when the new trees are installed, staff will be spraying a pre-emergent herbicide and placing mulch in the planter beds to help with the mitigation of weeds in the area.

Vegetation overgrowth on the seawalls will also be addressed over the next two (2) to three (3) months based on weather. Districts staff will be working with City Corp to address any growth of vegetation on the seawalls. If there is any vegetation that is growing from a resident’s property onto public property (greenbelt, City fence, etc.) it will be removed.

FY 21 Goals

As we approach the end of the calendar year and mid-year budget for FY20, staff will continue to work with Mandalay resident to establish goals for FY21 and set priorities for work within the District.

Using 311 and Reporting Issues

Special Districts would like to encourage residents to utilize the 311 App when notifying the City of issues that they see within Mandalay Bay or throughout the City of Oxnard. This allows for a central location and tracking of issues and tasks. When “Making a Request” on 311 related to Mandalay Bay, please ensure you are selecting “Assessment Districts Request” to ensure that it is directed to the Special Districts Division regardless of the issue. Please note that if you are sending in a 311 regarding an area, but you are no longer in that area, 311 will tag you at your current location and not the location of the issue. You will need to move the tag on the map back to the location of the 311 report. When submitting a 311 request, please try to be as descriptive as possible regarding the issue, location or action needed so that Special Districts can deploy staff for corrective action in a timely fashion.

Mandalay will be the recipient of 75 new trees at no charge through a grant that was awarded to the City.

The City has begun to address growth over seawalls on the public property (Greenbelts, City fence etc.)

Staff will be looking at any vegetation that has been planted in an area that may affect the seawalls and will be
scheduling it for removal.

This includes any trees that may be planted on or near a seawall.
It is the goal of the City to remove anything that may have an invasive root structure that could damage the seawall in anyway.

 

Staff has authorized work within the medians throughout Mandalay Bay to extend irrigation heads to ensure that
the medians are getting the proper watering coverage.

On May 11, 2019 the City of Oxnard held a Community Budget Meeting for fiscal year 2019 – 2020 at Blackstock School in south Oxnard. In its efforts to inform the residents, Oxnard City Manager Alex Nguyen and department heads are holding these budget meetings at several locations in the city, this is the first of four. Mr. Nguyen first presents a brief history that helps explain how the City of Oxnard has arrived at its current state. Facing a budget deficit of $9,200,000, department heads then give presentations describing the cuts on services and their impact in order to help explain how it plans to meet the shortfall.

On June 4, 2019 the city will hold a Public Hearing on the Proposed Budget, and on June 18, 2019 the City Council will receive the proposed 2019 – 2020 budget for Consideration and Adoption.

High Priority Goals

1: Agendize and approve Pilaster Project

We wish to request an item to be added to an Agenda as soon as possible.
Please agendize and approve an amendment to the Harbor OffShore* agreement to add a work order to proceed with the Pilaster Repair Project for the repair of (50) of the worst condition pilasters.

Harbor Offshore still is under contract with the City of Oxnard and has completed this type of work in the past and was included in the plans & estimates for the next phase which was placed on hold after being funded and fully permitted and they have the special equipment to do this project.

2: Reinstate our ability to meet with NBS to finish our funding district

At the City Council meeting on April 2nd following the Capital Improvement Presentation we raised the issue that the budget numbers indicated for the Seawall Repairs in Mandalay had no basis in reality as they stated numbers for a fund that does not exist and cannot exist until formed, brought to ballot and approved by voters. We estimate this as at least 2 years from the time we resume development of a funding district.

The Feasibility Study has not yet been completed therefore estimates are best guesses – this study was paid for out of Waterways fund 121 which we have been requesting (for many years) be addressed due to inadequate funding. The CITY presented a plan of tripling the assessment in 2006 which we were agreeable to and NOTHING HAS BEEN COMPLETED.

We were working with NBS and the City for well over a year until yet another internal changing of the guard in 2017 derailed that work. As it stands our district remains grossly underfunded and new policy changes have removed us from our 20 year involvement in participating in anything to do with seawall maintenance – we need to finish this work.

 

Also of Note and great concern: The TranSystems contract for seawall monitoring is due to expire in June

Although our Priority at this meeting was to schedule the delayed Pilaster Repairs the Water Quality Funding is still an important item!

SUBJECT: Approval of Third Amendment to Agreement for Trade Services with Weck Laboratories, Inc. for processing water testing samples for the Channel Islands Water Quality Issue.
RECOMMENDATION: That the City Council approve and authorize the Mayor to execute the Third Amendment to Agreement No. A-7583 with Weck Laboratories, Inc. to: 1. Add the Special Districts Division to the Agreement’s Scope of Services; and 2. Increase the value of the Agreement from $900,000 to $960,000 for ongoing services relating to the Channel Islands Harbor water quality issue.

NOTE from CIWHA – the funding split was hotly contested at an earlier meeting regarding a need for testing and the final decision was to fund through Measure O.
The next decision to split the funding for a new contract for services was decided in a Committee meeting and though we contested the info consent agenda item – the following split this was passed:

The decision to take 55% of the funds needed for this phase was decided on by a simplistic GIS calculation of area.
We do not believe this to be fair considering development agreements for Seabridge and Westport, the boat density in those developments and the access for those developments through the main channel and public benefit of the waterways in general.

There was a great turnout of Mandalay residents at the April 2nd meeting!

While the city Council voted unanimously to approve the CIP, there was a clear message that Capital Improvement Projects that are funded should move forward.

Oxnard City Council Committee meeting structure, effective in January 2019

The City Council voted 4 -1 (Perello dissenting) in November 2018 to adopt Ordinance No.2949, establishing the new Council Committee meeting structure, effective in January 2019.

The City Council will have full Council meetings on the 1st and 3rd Tuesday evenings of each month, and the Council Committees will meet on the 2nd and 4th Tuesdays of each month, beginning January 22, 2019.

Speaker Cards at City Council Meetings

Public Comment:
Public comments shall be received at several times during each meeting for particular portions of the agenda as specified on the agendas.

Comments on agendized items are not heard until the particular item is called. Unless otherwise approved by City Council action, public comments relating to the subject matter of discretionary public hearings or public hearings required by law, shall be presented only at the time of the conduct of the hearing. Individuals desiring to speak are to address the Council from the speaker podium.

Speaker cards should be filled out and given to the City Clerk prior to public comment, although persons who wish to speak are not required to provide their names or addresses. A block of thirty (30) minutes time is set aside at the beginning of a regular
meeting to receive general public comment about issues not on the agenda. Public comments not heard 13 during this thirty minute period will be heard just prior to adjournment.

Speaker cards will not be accepted after the beginning of the general public comment period in order to allow for fair
allocation of time among the known speakers.

If the time required to complete general public comments exceeds 30 minutes, any public comments thereafter shall occur immediately prior to the adjournment of the meeting. If during public comment, a person expresses a concern regarding City Council staff or service, City Council may refer the nature of the concern to staff for investigation, resolution or a report.

Comments should focus on a specific matter within the Council’s jurisdiction. Members of the public are encouraged to present written comments, preferably in advance of the meeting, as a way to fully communicate their thoughts on agendized or non-agendized items. When written materials are presented, they should be submitted to the City Clerk for distribution and record keeping ahead of time.

Videos, PowerPoint or similar presentations during public comment ordinarily are not permitted. Prior notice and coordination with the City Clerk is strongly encouraged and the Mayor reserves the privilege to limit such requests as necessary for the effective conduct of the meeting.

Public comment on regular business items normally follows staff’s presentation of the staff report, clarifying questions from Council members and applicant comments as necessary and appropriate.

Speaker cards should be filled out and given to the City Clerk prior to public comment.
Unless additional time is granted by the presiding officer, each person shall limit public comments to three minutes on any agenda item at a meeting with a cumulative total of ten minutes for all agenda items at such meeting, provided that such ten minute limit shall be voluntary. The presiding officer may grant a representative of a large speaker group additional time (up to ten minutes) to speak for the group on any agenda item.

A person wishing to address City Council shall first be recognized by the presiding officer.

Each person shall address all remarks to City Council as a body, not to any member thereof and not to staff. No person, other than a Council member and the person having the floor, shall be permitted to enter into any discussion without recognition by the presiding officer.

Oxnard District-Based Elections (map and Information)

On February 27, 2018, the City Council held the final public hearing regarding districting and approved by a 4 to 1 vote the first reading of an ordinance implementing its decision regarding the district map and the sequencing of the elections in each of the districts. The City Council adopted this ordinance at its meeting on March 6, 2018. The ordinance became effective immediately.
